Terms of Service
Article 1. Purpose
These Terms and Conditions are intended to define the rights, obligations, and responsibilities of DEAR SOOA Co., Ltd. (hereinafter referred to as the "Company") and users in connection with the sale of products and use of related services provided through the DDUDDI DDUDDI online store (hereinafter referred to as the "Store") operated by the Company.
Article 2. Definitions
- "Store" means the Shopify-based online store operated by the Company to provide users with goods or services (hereinafter referred to as "Products, etc.").
- "User" means any member or non-member who accesses the Store and uses the services provided by the Company in accordance with these Terms and Conditions.
- "Member" means a person who has registered for membership with the Store and continues to use its services.
- "Non-member" means a person who uses the Store without registering for membership.
- "Order" means the act of completing the payment process to purchase Products, etc.
Article 3. Publication and Amendment of the Terms and Conditions
- The Company will display these Terms and Conditions, its company name, representative's name, business registration number, mail-order business registration number, address, contact details, and other relevant information on the Store's main page or a linked page so that users can easily review them.
- The Company may amend these Terms and Conditions to the extent permitted by applicable laws and regulations.
- When amending these Terms and Conditions, the Company will announce the effective date and reasons for the amendment at least seven days before the effective date. However, where an amendment is unfavorable to users, the Company will provide advance notice within a reasonable period.
- If a user continues to use the services without expressly objecting after notice of the amended Terms and Conditions, the Company may deem the user to have agreed to the amended Terms and Conditions.
Article 4. Provision of Services
- The Company performs the following services:
- Sale of clothing for infants and young children and related products
- Provision of services relating to orders, payments, delivery, exchanges, returns, and refunds
- Membership management and customer support
- Other services determined by the Company
- The Company may change the details of Products due to circumstances such as products being out of stock, changes in technical specifications, or operational requirements.
Article 5. Membership Registration
- Users may apply for membership by entering the required information in the registration form prescribed by the Company and agreeing to these Terms and Conditions and related policies.
- The Company may reject a membership application or subsequently restrict or terminate membership in any of the following circumstances:
- Where false information has been provided
- Where another person's information has been misappropriated
- Where applicable laws or these Terms and Conditions have been violated
- Where there is a risk of materially interfering with the operation of the services
- Members must promptly update their registered information when it changes. The Company will not be liable for disadvantages resulting from a member's failure to promptly update such information.
Article 6. Membership Withdrawal and Termination
- Members may request withdrawal from membership at any time, and the Company will process the request in accordance with applicable laws and its internal procedures.
- The Company may restrict or terminate a member's membership in any of the following circumstances:
- Where the member infringes another person's rights or reputation
- Where the member intentionally interferes with the operation of the Store
- Where the member violates these Terms and Conditions or applicable laws and regulations
Article 7. Formation of an Order
- Users may complete an order by selecting Products from the Store and entering the required shipping and payment information.
- An order is formed when the Company issues an order confirmation or payment completion notice. However, the Company may reject or cancel an order for a legitimate reason, including insufficient inventory, a pricing error, a system error, or failure to obtain payment authorization.
- For orders placed by minors, the Company may verify whether consent has been obtained from a legal representative and may cancel the order if such consent has not been obtained.
Article 8. Payment Methods
Users may pay for an order using any of the following payment methods made available by the Company through the Store:
- Credit card or debit card
- Digital or mobile payment service
- Bank transfer
- Other electronic payment methods designated by the Company
Article 9. Supply and Delivery of Products
- Unless otherwise agreed with the user regarding the delivery date, the Company will dispatch Products within a reasonable period after confirming payment.
- The Company will provide important information concerning international delivery, including shipping destinations, shipping charges, customs clearance, import value-added tax, and customs duties, through the Store.
- Delivery may be delayed due to national customs policies, local delivery service conditions, natural disasters, public holidays, or other circumstances. The Company will notify users of such delays to the extent reasonably possible.
Article 10. Cancellation, Exchanges, and Returns
- Users may request cancellation, return, or exchange within seven days of receiving the Products.
- The right to cancel, return, or exchange may be restricted in any of the following circumstances:
- Where the Products have been lost or damaged for reasons attributable to the user
- Where the value of the Products has materially decreased due to the user's use or partial consumption
- Where the value of the Products has materially decreased over time to the extent that resale is no longer reasonably possible
- Where the packaging of reproducible Products has been damaged or opened
- Where Products that cannot be resold for hygiene reasons have been opened or used
- Where the Products differ from their description or advertising, or where the contract has not been performed as agreed, users may exercise their right to cancel within three months of receiving the Products or within 30 days of the date on which they became aware, or could reasonably have become aware, of the discrepancy.
- Users are responsible for return or exchange shipping costs arising from a change of mind. However, the Company will bear such costs where the return or exchange results from circumstances attributable to the Company, including defective Products, incorrect delivery, or a discrepancy between the Products and their description or advertising.
- Specific return addresses, return procedures, and shipping charge policies are governed by the Store's Refund Policy and Shipping Policy.
Article 11. Refunds
- After receiving a cancellation or return request and inspecting the returned Products, the Company will process the refund without undue delay in accordance with applicable laws and the policies of the relevant payment service provider.
- Refunds will generally be issued to the original payment method. If a refund to the original payment method is not possible due to the nature of that payment method, the Company may issue the refund using another reasonable method communicated to the user.
- Shipping charges, customs duties, and import taxes may be excluded from the refundable amount depending on the reason for cancellation and the policies of the relevant country. Further details are governed by the Store's policies.
Article 12. Prices, Taxes, and International Purchase Information
- Product prices displayed in the Store may vary depending on the selected country, currency, or promotional settings.
- International orders may be subject to additional charges, including customs duties, value-added tax, and customs clearance fees, under applicable local laws. Unless otherwise stated, users are responsible for such charges.
- The amount actually charged may vary due to exchange-rate fluctuations, card issuer fees, or payment service provider policies.
Article 13. Obligations of the Company
- The Company will not engage in any act prohibited by applicable laws, these Terms and Conditions, or public order and morals, and will endeavor to provide its services continuously and reliably.
- The Company will take appropriate measures to protect personal information and maintain security so that users can safely use the services.
- The Company will endeavor to address legitimate feedback and complaints submitted by users.
Article 14. Obligations of Users
Users must not engage in any of the following conduct:
- Providing false information
- Misappropriating another person's information
- Unauthorized alteration of information published in the Store
- Infringement of the intellectual property rights, reputation, or other rights of the Company or any third party
- Interfering with the operation of the Store or imposing an excessive burden on its systems
- Any act that violates applicable laws or these Terms and Conditions
Article 15. Intellectual Property Rights
- All rights in content made available through the Store, including trademarks, logos, images, text, designs, and videos, belong to the Company or the relevant lawful rights holder.
- Users may not reproduce, transmit, distribute, modify, display, sell, or commercially use such content without the Company's prior written consent.
Article 16. Disclaimer of Liability
- The Company will not be liable where it is unable to provide services due to force majeure events, including natural disasters, war, terrorism, strikes, telecommunications failures, or disruptions involving payment service providers or delivery companies.
- The Company will not be liable for service interruptions attributable to the user.
- The Company does not guarantee any profit, benefit, or utility expected by a user through the Store.
- The Company will not be liable for linked external websites, third-party payment methods, or third-party logistics and customs clearance services unless the relevant loss or damage is attributable to the Company.
Article 17. Protection of Personal Information
The Company complies with applicable laws and regulations to protect users' personal information. Further details are provided in the separately published Privacy Policy.
Article 18. Governing Law and Jurisdiction
- These Terms and Conditions and transactions between the Company and users are governed by the laws of the Republic of Korea.
- Any lawsuit arising from a dispute between the Company and a user will be subject to the court of first instance having jurisdiction under applicable laws and regulations.
